Official Jim Gauthier Kia Social Media Giveaway (“Giveaway”) Rules & Regulations

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A SALES, SERVICE, OR PARTS PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.

1. Eligibility: This Giveaway is open only to those who reside in Canada. Ages 16 and up can enter and be eligible to win.
2. Agreement to Rules: By participating, the Contestant (“You”) agree to be fully unconditionally bound by these Rules, and You represent and warrant that you meet the eligibility requirements. In addition, you agree to accept the decisions of Jim Gauthier Kia as final and binding as related to the content of this Giveaway.
3. Giveaway Period: Entries will be accepted online from the first to the last day of each month starting on November 1st, 2023 until an undetermined date. Draws for each individual Giveaway will take place within the first week of the following month. Entries are only valid for one draw period, namely the monthly period in which they are received. Limit of one entry per participant per month. Jim Gauthier Kia Reserves the right to end the contest at any time.
4. How to Enter: The Giveaway must be entered by 1) Identifying the stuffed toy bear wearing a Kia Logo t-shirt, known as “Kia Bear” on a currently active Meta Story posted within the current contest month. Comment on a Jim Gauthier Kia Meta account (Facebook or Instagram) or send a message to Jim Gauthier Kia identifying where and when you identified Kia Bear. Upon receipt of an accurate identification of Kia Bear, your username will be added to the random spin generator (located at WheelofNames.com) for the current month's draw. Kia bear appearances in reels, highlights, and/or posts are ineligible.
5. Prizes: The Winner of the Giveaway (the “Winner”) will receive a prize package that includes a random combination of one (1) full synthetic oil change up to 5L, and/or one (1) $25.00 local gas card, plus + two (2) Kia Branded merchandise options. Minimum retail value is $50.00 up to a maximum retail value of $155.00, taxes not included. Actual/appraised value may differ at the time of prize award. The specifics of the prize shall be solely determined by Jim Gauthier Kia. no cash or other prize substitution shall be permitted.
6. The prize is non-transferable. Any prize-related expenses, including without limitation any federal, provincial, and/or local taxes, shall be the sole responsibility of the Winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winner is permitted. Acceptance of the prize constitutes permission for Jim Gauthier Kia Ltd. to use the Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation unless prohibited by law.
7. Winner Selection and Notification: Winners will be selected on the first Tuesday of each Month utilizing a random “Spin to Win” method by entering all valid entries to wheelofnames.com under the supervision of Jim Gauthier Kia and recorded live for validity. The winner will be notified by Facebook Messenger or Instagram Direct Messenger within 24 hours following the selection of the Winner. It is the Winner's responsibility to claim the prize in person at Jim Gauthier Kia, 2536 McPhillips Street, Winnipeg MB R2P 2E3.
8. The odds of winning are dependent on the number of eligible entries received.
9. Jim Gauthier Kia shall have no liability for Winner’s failure to receive notices due to spam, junk e-mail, or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information.
10. If Winner cannot be contacted, is ineligible, fails to claim the prize within 30 days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as requested, the prize may be forfeited. Receipt by the Winner of the prize offered in this Giveaway is conditioned upon compliance with any federal, provincial, and local laws and regulations.
11. Privacy Policy: Information submitted with an entry is subject to the Privacy Policy stated on the Jim Gauthier Kia website.
12. Sponsor: This Campaign is in no way associated with Meta, Facebook, Instagram, or Kia Canada.

 

ANY VIOLATION OF THESE OFFICIAL RULES BY THE WINNER (at Jim Gauthier Kia’s sole discretion) WILL RESULT IN THE WINNER’S DISQUALIFICATION AS THE WINNER OF THE GIVEAWAY AND ALL PRIVILEGES AS THE WINNER WILL BE IMMEDIATELY TERMINATED.

Rights Granted by You: By entering this contest, You understand and agree that Jim Gauthier Kia and anyone acting on behalf of Jim Gauthier Kia, and Gauthier Autogroup licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Giveaway, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent.

Terms & Conditions: Jim Gauthier Kia. reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Giveaway should virus, bug, non-authorized human intervention, fraud, or other cause beyond Jim Gauthier Kia’s control corrupt or affect the administration, security, fairness, or proper conduct of the Giveaway. In such case, Jim Gauthier Kia may select the Winner from all eligible entries received before and/or after (if appropriate) the action taken by Jim Gauthier Kia.  Jim Gauthier Kia reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Giveaway or website or violates these Terms & Conditions.

Jim Gauthier Kia. has the right, in its sole discretion, to maintain the integrity of the Giveaway, to void votes for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer over that allowed by Campaign rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Giveaway may be a violation of criminal and civil laws.

THIS GIVEAWAY IS GOVERNED BY THE LAWS OF MANITOBA COURTS WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Giveaway, the participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Giveaway, shall be resolved individually, without resorting to any form of class action, exclusively before a court located in Winnipeg, Manitoba having jurisdiction.

Further, in any such dispute, under no circumstances shall the participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than the participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Giveaway). Participant further waives all rights to have damages multiplied or increased.
